Construction Defects

At a Special Meeting of the Association conducted on July 13, 2022, the following Motion was approved by more than 67% of the common ownership interest:
“To the extent required by Article 22 of the Declaration, it is moved to authorize the Association to commence and maintain any ‘proceeding’ as defined by Article 22 of the Declaration, including but not limited to, alternative dispute resolution and/or the filing of lawsuits and/or arbitration proceedings against the Developer, its agents, contractors and/or any other party, arising from and/or related to alleged construction defects present at the Project, including, but not limited to the assertion of causes of action based upon breach of warranty, breach of contract, and negligence, regarding PEX pipes, roof top mechanical equipment, fire rated walls, sprinkler pipes in garage, the parking garage lid, and/or any other construction defects subsequently discovered by the Association.”
